This Refund & Cancellation Policy governs all purchases made through the Notify'n platform operated by HMD Corp ("Company," "we," "us"). By making a purchase, you acknowledge that you have read, understood and agree to be bound by this policy.
Important: All subscription fees are generally non-refundable except as specifically described in this policy. Please read carefully before purchasing.

2. 14-DAY MONEY-BACK GUARANTEE
2.1 Eligibility
First-time paying subscribers to Notify'n may request a full refund within 14 calendar days of their initial paid subscription, subject to the following conditions:
First-Time Only: You have never previously had a paid Notify'n subscription
Same Account: The refund request comes from the original account holder
Limited Usage: You have not sent more than 1,000 emails during the refund period
Good Faith: The account was used for legitimate evaluation purposes
2.2 Not Eligible for Money-Back Guarantee
Returning customers or accounts that previously had paid subscriptions
Accounts associated with previously refunded customers (by email, payment method or organisation)
Upgrade purchases (upgrading from one plan to another)
Credit purchases or add-on features
Enterprise or custom-priced agreements
Purchases made using promotional codes or discounts
Accounts that have violated our Terms of Service or Acceptable Use Policy
2.3 How to Request
To request a refund under the money-back guarantee:
Email billing@hmdcorp.org from your registered email address
Include your account email, organisation name and reason for the refund
Submit the request within 14 days of your initial payment date
We will process eligible refund requests within 10 business days. The refund will be credited to the original payment method.
3. NON-REFUNDABLE ITEMS
The following are strictly non-refundable under any circumstances:
3.1 Consumed Resources
Sent emails (including bounced or failed deliveries)
Used API calls or credits
AI feature usage (AI Composer, AI Insights, Subject Line Optimiser)
Data processing or storage used
3.2 Time-Based Services
Elapsed subscription time beyond the 14-day guarantee period
Partial month usage
Unused time on cancelled subscriptions (except for annual plans as described below)
3.3 One-Time Purchases
Credit packs and top-ups
Domain verification fees
Add-on features or modules
Professional services (onboarding, training, migration assistance)
3.4 Enterprise Services
Custom development work
Dedicated infrastructure costs
Custom integrations
Consulting or advisory services
4. SUBSCRIPTION CANCELLATION
4.1 How to Cancel
You may cancel your subscription at any time through the Billing section of your account settings. Cancellation takes effect at the end of your current billing period.
4.2 Monthly Subscriptions
No refunds for partial months are provided
Your access continues until the end of the current billing period
You will not be charged for subsequent months after cancellation
Unused credits or emails do not carry over and are forfeited
4.3 Annual Subscriptions
Annual subscriptions are billed in full at the beginning of the subscription term. Upon cancellation:
No Cash Refunds: We do not provide cash refunds for unused months of annual subscriptions
Account Credit: At our sole discretion, we may issue account credit for unused full months remaining on your subscription, calculated at the monthly rate (not the discounted annual rate)
Access Continues: You retain access through the end of the paid annual term
No Pro-Rating: Partial months are not credited or refunded
4.4 Cancellation Before Trial Ends
If you cancel during a free trial period before being charged, no payment will be processed and your access will end when the trial expires.
5. BILLING ERRORS AND DISPUTES
5.1 Duplicate Charges
If you are charged twice for the same subscription period due to a billing error on our part, we will promptly refund the duplicate charge upon verification. Please contact us within 60 days of the erroneous charge.
5.2 Unauthorised Charges
If you believe a charge was made without your authorisation, contact us immediately atbilling@hmdcorp.org. We will investigate and, if the charge was truly unauthorised, process a refund. However, we reserve the right to require proof of the unauthorised nature of the charge.
5.3 Chargebacks and Payment Disputes
Before initiating a chargeback with your bank or credit card company, please contact us to resolve the issue. If you initiate a chargeback:
Your account will be immediately suspended pending resolution
If the chargeback is found to be invalid, you will be responsible for any fees incurred
Repeated or fraudulent chargebacks may result in permanent account termination
We may report fraudulent chargeback activity to credit agencies and law enforcement
5.4 Billing Error Notification Period
You must notify us of any billing errors or disputed charges within 60 days of the charge date. Claims made after this period may not be eligible for refund.
6. PLAN CHANGES
6.1 Upgrades
When you upgrade to a higher-tier plan:
The upgrade takes effect immediately
You will be charged a prorated amount for the remainder of your billing cycle
Upgrades are non-refundable once processed
6.2 Downgrades
When you downgrade to a lower-tier plan:
The downgrade takes effect at the start of your next billing cycle
No refunds or credits are provided for the current billing period
You retain access to higher-tier features until the end of the current period
Any usage exceeding your new plan limits will be charged at overage rates
7. ACCOUNT TERMINATION BY US
7.1 Termination for Cause
If we terminate your account due to a violation of our Terms of Service, Acceptable Use Policy or any other agreement:
No refunds will be provided for any fees paid
All unused credits and prepaid balances are forfeited
We may retain and destroy your data in accordance with our policies
7.2 Termination for Convenience
If we discontinue the Service entirely or terminate your account without cause:
We will provide at least 30 days' notice when practicable
We will refund any prepaid fees for unused full months of service
This is your sole remedy for termination without cause
8. ENTERPRISE AGREEMENTS
If you have entered into an Enterprise Agreement or Master Service Agreement with us, the refund and cancellation terms in that agreement supersede this policy. Enterprise agreements may include different terms regarding:
Minimum commitment periods
Early termination fees
Custom refund provisions
Volume commitments and true-up provisions

9. REFUND PROCESSING
9.1 Processing Time
Approved refunds are typically processed within 10 business days. The time for the refund to appear in your account depends on your payment provider:
Credit/Debit Cards: 5-10 business days
PayPal: 3-5 business days
Bank Transfer: 10-15 business days
9.2 Refund Method
Refunds are issued to the original payment method used for the purchase. We cannot issue refunds to different payment methods, bank accounts, or to third parties.
9.3 Currency
Refunds are issued in the currency of the original transaction. Any currency conversion gains or losses due to exchange rate fluctuations are your responsibility.
10. ABUSE PREVENTION
We reserve the right to refuse refund requests or restrict access to refunds if we detect abuse of our refund policy, including but not limited to:
Multiple accounts requesting the 14-day money-back guarantee
Repeated subscription and cancellation patterns
Excessive usage during refund periods
Fraudulent chargeback activity
Sharing accounts to circumvent refund limitations
We may also take action including permanent account suspension and legal action in cases of egregious abuse.
11. DATA AFTER CANCELLATION
Upon cancellation or refund:
You should export any data you wish to retain before cancellation
We retain your data for 30 days after account closure for potential reactivation
After 30 days, your data will be permanently deleted in accordance with our Privacy Policy
Certain data may be retained longer for legal compliance or dispute resolution
